Auckland-based, the leading erectile dysfunction (ED) treatment and care company, has agreed to pay $3.6 million to settle a class-action lawsuit by claiming that the company failed to adequately warn consumers about the high risk of erectile dysfunction (ED) and the potential for serious health consequences, including stroke.
The settlement applies to the company's wholly-owned subsidiary, Pfizer's worldwide operations and medical products division.
The settlement, announced Friday by Pfizer's New York District Court, includes the $3.6 million in additional compensation under the settlement. The company will pay $6 million in damages and costs of litigation, including costs of defending its patent-based medicine business, Pfizer's medical products business, its wholly-owned subsidiary and other related entities.
Pfizer's patent protection includes a number of patents related to its erectile dysfunction (ED) treatment known as Cialis, which it owns and operates as a licensed, trade-in drug. The company's products include erectile dysfunction drugs known as tadalafil (Cialis) and sildenafil (Viagra) that are sold by Eli Lilly & Co.
Pfizer also holds exclusive rights in Viagra, Cialis and tadalafil's erectile dysfunction drug, Adcirca, which is made by Sanofi-Aventis.
The settlement provides Pfizer with legal recourse for any legal consequences that have occurred since the companies were first notified of the settlement. Under Pfizer's agreement, the settlement will allow Pfizer to pay $1.6 million in damages, including costs of defending its business, to the New York District Court in Auckland, New Zealand, where it was seeking class-action status and damages related to the alleged negative effects of the settlement. In addition, Pfizer is allowed to continue selling its own product, which is known as its own brand of sildenafil, under the name "Viagra."
Pfizer is also granted a license to conduct research on the effects of sildenafil, which is also sold under the name Viagra, on the U. S. market.
The settlement includes the company's share price of $3.5 million, as well as other damages and costs related to the company, including $1.4 million in attorneys' fees and expenses associated with representing its patent-protected monopoly.
The company's share price of $3.5 million was not disclosed in the settlement, and the settlement will remain in force until the settlement is finalized.

Pfizer said that it was seeking damages from the company for its alleged negative effects on the U. market, including the company's monopoly patent, the company's patent on Viagra and the company's desire to continue to sell its own product.
"We are disappointed with the outcome of this matter, and we are cooperating with the court in an effort to resolve the matter," said David Smith, Pfizer's CEO.
"Pfizer will continue to provide consumer health products and pharmaceutical products as required by New York State law to the New York State Department of Health and the New York State Department of Education."
Pfizer is also seeking damages for its alleged negative effects on its New York market.
The company's New York headquarters will remain in New York City until the settlement is finalized.
Pfizer's New York office will provide a free supply of tadalafil at the site of a new $2.5 million erectile dysfunction treatment, which is expected to be sold at the site of Pfizer's New York office.

• Theophylline, used to treat asthma
• Antibiotics:- Clarithromycin, Erythromycin and Telithromycin
• Anti-fungals such as itraconazole and ketoconazole
• Seizure medication:- carbamazepine, oxcarbazepine, phenobarbital, phenytoin and primidone
• Heart or blood pressure medication:- disopyramide, amiodarone, quinidine and procainamide
• Anti-viral medication:- telaprevir, atazanavir, retonavir, indinavir, saquinavir and cobicistat
• Recreational drugs:- amyl nitrate (poppers)
